The Business of Birth Photography Digital Download Content Terms and Conditions Agreement
This agreement is made between Adelaide Birth Photographer (ABN 89 021 813 459) (hereinafter referred to as “ABP”) and the Participant (hereinafter referred to as “the Participant”).
1. Acceptance of the Terms and Conditions:
The Participant acknowledges and agrees that by purchasing digital documents, the Participant accepts these Terms and Conditions and agrees to be bound by them.
2. Payment:
The Participant will be issued with a tax invoice after the payment is processed by ABP. The Participant must pay the full amount within 14 days from the date of the invoice (unless otherwise agreed) provided always that payment must be made in full before accessing the content.
3. Cancellations:
a. Cancellations by the Participant must be received by email at least 7 days after the purchase was made, so long as the content has not been downloaded. Failure to do so will incur the loss of the full purchase price.
4. Intellectual Property and Copyright:
a. All the contents of the purchased downloadable content (including but not limited to ABP’s resources, books, materials, tools, aids methodology, know-how, concepts, framework, methods, techniques, systems, designs) are intellectual property and all rights are reserved.
b. The Participant shall not use ABP’s, Victoria Berekmeri, Cassie Emmett or any other Patricipant's Intellectual Property other than for the Participant’s personal use.
c. The Participant shall not use ABP’s Intellectual Property for commercial gain to mentor, facilitate or educate others.
d. The Participant agrees not to, duplicate, distribute, teach, or train from the mentoring materials in any manner whatsoever without the express written consent of ABP. Any unauthorized distribution of proprietary concepts, materials, and intellectual property by you or your representatives is prohibited and will result in legal action and full damages if these terms are violated in order to protect rights.
5. Personal Property:
The Participant acknowledges and agrees that ABP is not responsible and will not be held liable for any damage, theft or damage to the Participant’s personal property as a result of undertaking tasks relative to the digital content purchased either prior to, during or after the purchase was made.
6. Medical Condition and Release:
The Participant must not participate in any physical activities outlined in the digital content if he or she is not feeling well, is sick or has any known medical condition affecting their ability to participate in physical activities.. By participating in the activities outlined in the digital content, the Participant agrees to release and hold harmless ABP and any of its officers, employees and agents from any liability in this regard to the extent permitted by law. The Participant and the Participants also waive to the fullest extent permitted by law in this regard any rights to any causes of action that the Participant may have now or in the future against ABP.
7. Limit of Liability:
a. The Participant understands and agrees that they are solely responsible for evaluating the value of any comments or suggestions made throughout the purchased content. ABP expressly disclaims any duty of care or liability to any person including, without limitation, Victoria Berekmeri & Cassie Emmett, arising out of reliance on anything said or represented by ABP.
b. The Participant understands that all supplied documentation associated with ABP is only general. It does not constitute, and should be not relied on as, legal advice. It is recommended the Participant seek advice from a qualified lawyer on the legal issues before acting on any legal matter.
8. Agreement to this Contract:
Upon processing the order and by paying the designated fee, the Participant is agreeing to accept all the above conditions. The person who makes the booking does so on behalf of all the Participant is bound by these Terms and conditions.
The Business of Birth Photography Online Course Terms and Conditions Agreement
This agreement is made between Adelaide Birth Photographer (ABN 89 021 813 459) (hereinafter referred to as “ABP”) and the Participant (hereinafter referred to as “the Participant”).

The Participant acknowledges and agrees that by participating in the online course, the Participant accepts these Terms and Conditions and agrees to be bound by them.
2. Payment:
The Participant will be issued with a tax invoice after the Enrolment Form is processed by ABP. The Participant must pay the full amount within 14 days from the date of the invoice (unless otherwise agreed) provided always that payment must be made in full before the online course commences.
3. Cancellations:
a. Cancellations by the Participant must be received by email at least 7 days prior to the course commencement date. Failure to do so will incur the loss of the full online mentoring fee.
b. If ABP cancels the online course through no fault of the Participant, the Participant will be informed by email or phone and any monies paid by the Participant will be refunded in full within 7 days of the cancellation. ABP is not responsible for any other costs which the Participant may have incurred.
4. Intellectual Property and Copyright:
a. All the contents of the online course (including but not limited to ABP’s resources, books, materials, tools, aids methodology, know-how, concepts, framework, methods, techniques, systems, designs) are intellectual property and all rights are reserved.
b. The Participant shall not use ABP’s, Victoria Berekmeri, Cassie Emmett or any other Patricipant's Intellectual Property other than for the Participant’s personal use.
c. The Participant shall not use ABP’s Intellectual Property for commercial gain to mentor, facilitate or educate others.
d. The Participant understands and acknowledge the shared materials, and information presented during or as part of the online course are confidential, copyrighted, and proprietary to their respective creators. As such The Participant agrees not to, duplicate, distribute, teach, or train from the mentoring materials in any manner whatsoever without the express written consent of ABP. Any unauthorized distribution of proprietary concepts, materials, and intellectual property by you or your representatives is prohibited and will result in legal action and full damages if these terms are violated in order to protect rights.

The Participant acknowledges and agrees that ABP is not responsible and will not be held liable for any damage, theft or damage to the Participant’s personal property as a result of undertaking tasks relative to the online mentoring either prior to, during or after the course.

The Participant must not participate in any physical activities outlined in the online course if he or she is not feeling well, is sick or has any known medical condition affecting their ability to participate in physical activities.. By participating in the online mentoring, the Participant agrees to release and hold harmless ABP and any of its officers, employees and agents from any liability in this regard to the extent permitted by law. The Participant and the Participants also waive to the fullest extent permitted by law in this regard any rights to any causes of action that the Participant may have now or in the future against ABP.
7. Online Course Schedule and Agenda:
All course schedules and plans are subject to change at ABP's discretion.
8. Confidentiality:
The Participant agrees to keep the discussions and conversations that take place during the online course and within the group forum confidential.
The Participant agrees that the obligations of confidentiality and releases in this agreement are ongoing.

a. The Participant understands and agrees that they are solely responsible for evaluating the value of any comments or suggestions given during the online course. ABP expressly disclaims any duty of care or liability to any person including, without limitation, Victoria Berekmeri & Cassie Emmett, arising out of reliance on anything said or represented by ABP.

Upon registering for this online course and by paying the designated fee, the Participant is agreeing to accept all the above conditions. The person who makes the booking does so on behalf of all the Participant is bound by the booking conditions.
The Business of Birth Photography Workshop / Bootcamp and Conditions Agreement
This agreement is made between Adelaide Birth Photographer (ABN 89 021 813 459) (hereinafter referred to as “ABP”) and the Participant (hereinafter referred to as “the Participant”).
1. Acceptance of the Terms and Conditions:
The Participant acknowledges and agrees that by participating in the workshop, the Participant accepts these Terms and Conditions and agrees to be bound by them.
2. Payment:
The Participant will be issued with a tax invoice after the Workshop Registration Form is processed by ABP. The Participant must pay the full amount within 14 days from the date of the invoice (unless otherwise agreed) provided always that payment must be made in full before the workshop.
3. Cancellations:
a. Cancellations by the Participant must be received by email at least 31 days before the date of the workshop. Failure to do so will incur the loss of the full workshop fee.
b. If ABP cancels a workshop through no fault of the Participant, the Participant will be informed by email or phone and any monies paid by the Participant will be refunded in full within 7 days of the cancellation. ABP is not responsible for any other costs which the Participant may have incurred, including but not limited to car rental, insurance, photographic purchases and/or rentals.
4. Intellectual Property and Copyright:
a. All the contents of the workshop (including but not limited to ABP’s resources, books, materials, tools, aids methodology, know-how, concepts, framework, methods, techniques, systems, designs) are intellectual property and all rights are reserved.
b. The Participant shall not use ABP’s, Victoria Berekmeri, Cassie Emmett or any other Patricipant's Intellectual Property other than for the Participant’s personal use.
c. The Participant shall not use ABP’s Intellectual Property for commercial gain to mentor, facilitate or educate others.
d. The Participant understands and acknowledge the shared materials, and information presented during the workshop are confidential, copyrighted, and proprietary to their respective creators. As such The Participant agrees not to, duplicate, distribute, teach, or train from the workshop materials in any manner whatsoever without the express written consent of ABP. Any unauthorized distribution of proprietary concepts, materials, and intellectual property by you or your representatives is prohibited and will result in legal action and full damages if these terms are violated in order to protect rights.
5. Catering:
The Participant is responsible for advising ABP, at least 7 business days before the workshop, of any special dietary requirements. Although every reasonable effort will be made to satisfy these requirements, ABP does not guarantee that the Participant’s requirements will be met. ABP accepts no responsibility for any reaction to any food or beverage supplied during the workshop.
6. Personal Property:
The Participant acknowledges and agrees that ABP is not responsible and will not be held liable for any damage, theft or damage to the Participant’s personal property at the venue prior to, during or after the workshop.
7. Medical Condition and Release:
The Participant must not participate in the workshop if he or she is not feeling well, is sick or has any known medical condition affecting their ability to participate in activities involving mild physical activity. By participating in the workshop, the Participant agrees to release and hold harmless ABPW and any of its officers, employees and agents from any liability in this regard to the extent permitted by law. The Participant and the Participants also waive to the fullest extent permitted by law in this regard any rights to any causes of action that the Participant may have now or in the future against ABP.
8. Workshop Schedule and Agenda:
All workshop schedules and plans are subject to change at ABP's discretion depending upon weather, health and safety considerations, or any other factor related or unrelated to photographic opportunities.
9. Confidentiality:
The Participant agrees to keep the discussions and conversations that take place during the workshop confidential.
The Participant agrees that the obligations of confidentiality and releases in this agreement are ongoing.
10. Model Release:
By participating in the workshop, the Participant understands that portions of the workshop may be recorded in video and audio, the Participants personal image photographed and captured for marketing purposes by ABP. The Participant agrees that APB have the right and permission to use such recordings and photographs for marketing, advertising, or any other purpose in media or format, online and/or offline, now or hereafter without further compensation, permission, or notification to you. The Participant understands and agrees that all recordings from ABP are the exclusive rights of Victoria Berekmeri and Cassie Emmett; and the Participant does not expect compensation for the use of recordings or photographs in which they appear or speak.
11. Limit of Liability:
a. The Participant understands and agrees that they are solely responsible for evaluating the value of any comments or suggestions given during the workshop. ABP expressly disclaims any duty of care or liability to any person including, without limitation, Victoria Berekmeri & Cassie Emmett, arising out of reliance on anything said or represented by ABP.

12. Agreement to this Contract:
